1. Acceptance of Terms

By accessing or using the services of Ballard Trucking LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all users of our freight brokerage services, website, and related offerings.

2. Services

Ballard Trucking LLC provides freight brokerage services including:

  • General freight transportation across the contiguous 48 states
  • Oilfield equipment hauling and logistics
  • Building materials transport
  • Local and regional delivery services
  • Carrier vetting and qualification

We operate as an FMCSA Authorized freight broker (USDOT 3183884 | MC 129143). We are not a motor carrier and do not physically transport freight. We arrange transportation through qualified, independent carriers.

3. Booking and Payment

  • All freight shipments require a signed shipping agreement or broker-carrier agreement.
  • Quoted rates are valid for the timeframe specified and subject to change based on market conditions.
  • Payment terms are as specified in each individual agreement, typically Net 30 days from invoice date.
  • Late payments may incur interest charges of 1.5% per month or the maximum rate permitted by law.
  • Shippers are responsible for accurate freight descriptions, weights, and dimensions.

4. Cancellation Policy

  • Cancellations made more than 24 hours before scheduled pickup may be subject to a $250 cancellation fee.
  • Cancellations within 24 hours of pickup may incur charges up to the full quoted rate.
  • No-shows will be billed at the full quoted rate plus any applicable detention fees.
  • We reserve the right to cancel shipments due to weather, safety concerns, or regulatory restrictions.

5. Liability and Insurance

  • As a freight broker, Ballard Trucking LLC is not liable for loss or damage to cargo during transit.
  • Carriers are responsible for cargo from pickup to delivery as specified in the bill of lading.
  • Shippers must maintain adequate cargo insurance. We recommend coverage for the full value of goods.
  • Claims for loss or damage must be filed with the responsible carrier within 9 months of delivery.
  • We carry contingent cargo insurance and general liability insurance as required by FMCSA regulations.

6. Carrier Responsibilities

  • Carriers must maintain proper FMCSA operating authority and insurance coverage.
  • Drivers must hold valid CDL licenses and comply with all DOT regulations including hours of service.
  • Carriers are responsible for proper loading, transport, and unloading of freight.
  • Any claims of cargo damage must be noted on the bill of lading at time of delivery.

7. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through:

  • Informal Resolution: Contact us first to attempt to resolve the matter amicably.
  • Mediation: If informal resolution fails, parties agree to mediation before pursuing legal action.
  • Governing Law: These terms are governed by the laws of the State of Texas.
  • Jurisdiction: Any legal proceedings shall be conducted in Freestone County, Texas.

8. Limitation of Liability

To the maximum extent permitted by law, Ballard Trucking LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability shall not exceed the brokerage fees paid for the specific shipment in question.

9. Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of modified terms.
